Once an order is in the possession of Expert Grading Service, LLC (EGS), the full cost of the service is realized. 

International orders received cannot always be insured for the same amount when books are being returned to the sender.

Orders that have not been paid for which have been held for one month (30 days) past the order’s expected return date will begin to incur storage fees. Storage fees will be $100.00 per month or 3% of the total value of the books (whichever is greater) per month, retroactive to the date the books were due to ship. If three months (90 days) pass without full payment, books will become property of EGS and will be liquidated to recuperate grading service and other fees.

CUSTOMERS ASSUME ANY RISK OF LOSS OR DAMAGE to orders during shipment to and return shipment from EGS.

EGS does not provide grade protection or any type of guarantee for orders submitted to us. Due to the fragile nature of collectibles, you acknowledge that techniques used by EGS for pressing, restoration, removal, or slabbing services may result in new defects or damage to the comic/art, including, but not limited to, spine splits, popped staples, paper pieces chipping off, creases, and stains. You acknowledge that services provided by EGS with respect to a submission may result in a lower grade or no grade subsequently being assigned to such collectible by itself or any other company. BY SUBMITTING A COLLECTIBLE TO EGS, THE CUSTOMER WAIVES ANY RIGHT TO ASSERT ANY FORM OF LEGAL CLAIM AGAINST EGS WITH RESPECT TO A LOWER GRADE OR NO GRADE SUBSEQUENTLY BEING ASSIGNED TO SUCH COLLECTIBLE BY EGS OR ANY OTHER GRADING COMPANY, UNLESS CAUSED SOLELY BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF EGS.

EGS DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING ITS SERVICES. IN NO EVENT SHALL THE COMPANY BE LIABLE TO THE CUSTOMER OR ANY OTHER PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE COMPANY TO THE CUSTOMER OR ANY THIRD PARTY FOR WHOM THE CUSTOMER MAY BE ACTING, ARISING FROM ANY CAUSE, ACT, OMISSION OR OTHER CIRCUMSTANCE, EXCEED THE FEES PAID OR PAYABLE FOR THE SERVICES ORDERED PURSUANT TO THE APPLICABLE ORDER FORM.

EGS will use reasonable care with respect to orders submitted for services. In the event that EGS determines that an order is damaged due to negligence or lost while in the company’s possession, the customer’s sole remedy will be compensation based upon the company’s good faith determination, in light of what EGS believes to be reliable and relevant information. THE AMOUNT OF COMPENSATION WILL NOT NECESSARILY BE BASED UPON, BUT IN NO EVENT WILL EXCEED, THE FEES PAID OR PAYABLE FOR THE SERVICES ORDERED PURSUANT TO THE APPLICABLE ORDER FORM.

Customers are responsible for inspecting all items immediately upon receipt from EGS. EGS shall have no liability for any damage or errors unless reported within fourteen (14) calendar days from the customer’s receipt of the items.
